His ,portion of the contract is complete and as per consent (he was never going to build your retaining walls) but the development is not yet complete so you will need to do the retaining/landscaping first (possibly needing a full DA-did the builder give you the option of going via a full DA or did you decide to do landscaping yourself because price seemed too high? Just curious. I have done retaining wall and the driveway, but builder only mention the landscaping after giving me house keys when i noticed that there was no occupancy certificate.
