Our land developer is saying that the council is taking a long time which prevents them to complete the subdivision works on time. They started subdivision works last Nov 2021 but up to now, they haven't flattened the land, and road constructions are still incomplete. I was expecting that the existing road works (e.g. widening and adding footpaths) should have been completed in 2 months. Maybe it is a developer issue and they are just using council, the weather, and covid as scapegoats. Any advice is much appreciated. If we rescind the contract, then it means we will lose the 5% deposit we paid on land and building. Should we wait a little longer and be more patient? The stages allows the developer to ride the market and increase their land price by +$10k-$50k stage to stage. It also is a more manageable process dealing with 30 odd blocks, as not only the construction costs but also the council contributions. The rego is based on generally a 4 months construction phase for a normal easy subdivision, covid has caused major delays even to items like large concrete pipes (some cases +3mths). The stage can only be lodge for registration once all the works are completed, inspected by council and the Ascons (as constructed plans - sewer, stormwater lines have been produced). There is no timeframe that the developer must lodge for rego other than how quickly they want to settle the blocks and get paid.
