Just because your neighbouring houses are further back ( as is yours currently ) doesn't mean you have to be in line with theirs ( under DA rules anyway ). Going through CDC however you would have to be approximate to theirs. Going through council for a DA , you would have a pretty strong argument. The disappointing part is we are trying to prevent building out into the backyard (preserve greenspace) by building over the existing driveway and the only way to achieve this is with a Development Application. Typing out loud: There should be more fine print added to CDC rules which control when and why you can and can't push forward beyond the neighboring properties average. Something like; you can extend forward up to your existing setback up to 80% of the front of your home at ground floor, no closer than 1500mm to the side boundaries. Add an extra 500mm setback at level 1. This would cover my needs and we certainly won't be impacting the neighbors under CDC (even with my dream rule added) however if we go with a DA the allowance far greater under the State Planning rules.
