Possession is not ownership, not even close, don't talk about things you have no idea about. And I clearly pointed out that the contract would need to be negotiated and require specific drafting and a solicitor should be consulted. Standard contracts are meaningless unless OP has already signed one, parties can make just about whatever amendments they like provided they both agree, including granting access to live in a granny flat on the premises or they could just use a different contract entirely. Try and at least stay on topic if you're going to spout gibberish. Your comment is so off point and irrelevant to the conversation i don't even know where to begin. Might as well argue with a toddler. I digress, could come in handy when they need an extra pair of hands on site, don't expect to be paid $50/hr thought (humour) The builder 'owns' the site about as much as a tenant 'owns' a property they are renting. They have possession for the purposes of construction. Re: Knock down rebuild - where to live? 14Nov 28, 2021 7:53 pm There would be no problem, some second storey builds have families remain downstairs, so no problem if it is fenced and safe. Never trust a builder who tries to keep you off the site, they forget who they work for. Re: Knock down rebuild - where to live? 15Nov 28, 2021 10:49 pm Much appreciated guys. All the help has been fantastic. Re: Knock down rebuild - where to live? 16Nov 29, 2021 4:43 am simongrunwald Hey guys, I'm looking to do a knockdown rebuild very soon and im just preparing where to live during the building process. My main question is. - I have a completed granny flat on my property that will be out of the way of the actual area of construction. Would there be an option for me to live there during the construction period? I have even come up with the idea I could actually make an access point in my neighbor's fence so I can leave the area without having to go near the construction area. If i was able to get all the relevant connections made to keep the flat up and running and avoid the construction site would this be possible? Rather than me having to move and pay for another property for the duration? If anyone can guide me it would be greatly appreciated. Thanks in advance. Simon. Hi Simon I hope you don't mind me adding my two cents to this thread as it's a really interesting question you pose. So, in my opinion the answer to your question depends on what style of builder you choose. If you choose a project home builder I think there is only a small chance that you will be able to live onsite as they use the HIA or MBA contracts and you effectively grant them exclusive access rights to your property, as they don't want you on their buildings sites. Now, it should be a simple process to carve your granny flat out of that contract nominated building area and if there is a safe access route to the granny flat, carve that out as well, you would do this by preparing a plan that would be annexed to the contract along with some special conditions. Having said that, you might struggle to find a project home builder who is willing to work with you as they are running sausage making factories and don't do well with anything unusual. On the other hand, custom builders are used to be flexible so you would have no issues. We sometimes do renovations with people living in their homes, not fun but hey, you do what you have to do. So my advice is, yes it is possible, you just have to find a builder who is prepared to be flexible with your needs. Simon Just to chime in - you can absolutely live in your granny flat - I am doing exactly that as I type! I just negotiated it with my builder. In today’s market with extended delivery times it’s the best decision I have made during this whole building journey! Re: Knock down rebuild - where to live? 18Dec 23, 2021 3:49 pm If it was me, I would just find a builder that agreed to my terms of occupancy. If he doesn't, goodbye builder. There are so many builders out there, there will probably be many who will agree. Re: Knock down rebuild - where to live? 19Apr 02, 2022 10:52 pm Have finally chosen a builder and they have said I can't stay on the property. It really sucks as the granny flat will be totally blocked off from the build and I also have the neighbour allowing me to use her property to get to and from my flat. Is there any options left? Thanks in advance. Re: Knock down rebuild - where to live? 20Apr 03, 2022 1:26 am simongrunwald Have finally chosen a builder and they have said I can't stay on the property. Thanks in advance. Have they told you why? I can honestly think of no reason why they wouldn’t so there must be some reason they’re saying no. As I said, we live in our granny flat and our house is being built not 2 meters in front of the granny flat.
