I assume this will still lands on us but very frustrating when we are the innocent bystanders assuming that the architect, structural engineers and builders who all signed off on the work reviewed it properly .. Re: Changes to building contract - who pays the variation 4May 12, 2021 11:23 am BoscoB Hi Our builder has advised us post-contract signing that they cannot deliver on a couple of aspects of our build. Specifically, a window that is too large to be openable and a sliding window door that was designed as a cavity slider by our architect but cannot be achieved due the wall space we would need to achieve it. We accept that these changes are necessary but are now facing variation costs because of the change in design - is this reasonable? or should the variations sit with the builder who signed a contract to deliver something they are now advising cannot be done? Thanks Sandra Hi Sandra it really depends on your contract. It sounds like you were responsible for your own design and engineering, and typically if there is an issue with a drawing provided by you then the variation will sit with you unless you have a contract condition that precludes this.
