I have a lot in Merrylands, Cumberland council NSW, my lot is 495m2 with 15m frontage. Without considering the average setback from the primary road of the 2 nearest dwelling houses, which rule should I follow? Cumberland DCP (Holroyd Development Control Plan 2013): The minimum setback from the principal street frontage is 6 metres or , SEPP Housing code: 4.5m for lot size from 300m2-900m2. Thank you, Its up to you , DA or CDC , then you choose applicable controls. Either way, its a common requirements to both pathways averaging existing neighbours setbacks. But if you have a unique situation and need to work with minimum front setbacks, then DA is best to vary the control. You can call council to speak with duty planner, they will be able to provide guidance on this. Thank you, Duo2 CDC and DA are totally different pathways. With a DA your approval is via Council, and CDC is via a private certifier. Not every property is suitable for CDC in fact some properties cant use the CDC pathway. So before you decide which route you will take you need to order a 10.7 certificate from your council and that will tell you whether the CDC via the General Housing Code Sepp is applicable to your site. In my opinion the general housing code can be a challenge to interpret sometimes. So its best to talk to an expert. SEPP/CDC prevails and will overide all DCP controls. I also concur with above comment. The process suggested will confirm also which pathway and site control best for your property.
