They can sue you for loss of profit and maybe even copyright if its a similar design. I'm surprised that the lending institution hasn't said something to you. We want to terminate HIa contract and dont want to build the house at the moment. The builder refuse to terminate the contract instead threaten us that he wil sue us. Can you please share with me were u able to terminate the HIA contract? Did u have to pay for it? How did u manage to get out from the HIA contract. Thanks you in advance. Maya quote="Ash jolly"]Hi, We have signed HIA contract with one of builder in Sydney Feb 2020, our DA got approved in March and April I just texted on builder mobile that We may not proceed cause of current situation but he never replied back. Later on found another builder with better price and made some changes on previous plan and reapplied DA approval again. So just wondering that previous builder can take any action against us or what are best options to come out from Contract? I would suggest you to have chat with builder and explain him . In our case we got termination letter from builder and paid him some certificates cost which he spent, but he helped us as well. So it’s better to have chat with them and get out of it, if you went to legal advise they gonna rip u off. Re: HIA building contract 10Oct 02, 2020 8:09 pm Thank you for ur suggestion . You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16693 10 12404 Unless there is something in special conditions the builder does not have to give you timeline.
