Dear All,
Burbank have sent out letters to all new home buyers stating that you need to sign their form to allow an Independent Inspector or Consultant to review your home.
Under the law you have rights. Those rights are to have anybody inspect your home at anytime.
Download Domestic Building Contracts Act Vic 1995. Look at part 17 and part 19. See Below.
Lets be very clear. The Independent Inspector that they talk about in the letter is the Surveyors. Yes they look at the Mandated items in the Australian Standards. However they are receiving the payment from the builder indirectly from you.
They do not look at the home from the Quality of finishes perspective and if they did such a great job, then Independent Inspectors or Consulate would not have a job.
Please note that Consumer Affairs Victoria clearly state that you should have an Independent Professional on your side. See in yellow below.
Do not be fooled by this letter. It will set up a framework that you are bound by rather than existing common law rights.
I would suggest that you ask Burbank to put in writing what happens if you don't sign........ Simple the laws of Victoria are applied which are in your favour.
Any body looking to buy a house should consider what builders are trying to do to manipulate your rights.
