Browse Forums Building A New House 1 Nov 02, 2019 8:57 am Hi Guys, We are currently disputing a variation raised by our builder. The piering went ahead without our prior consent. Has anyone been hit with the same variation for additional lineal meters of piering? If so, did your builder present any evidence to confirm the actual total lineal meters done onsite? We are being charge more than what is on the structural engineering report. Since we were not aware that they were already doing this onsite, we are wondering if there is anything that we can ask from our builder to confirm this. But yes the builder should of let you know. Again its hard the builder is damned if he doesn't do the piers and the house cracks because they aren't deep enough then he's in trouble if he has to go deeper then estimated. Are there fixed site costs? Was it a provisional cost (PC)? most site works are provisional due to the nature of the works its very hard to know what they are going to dig up. Can your builder supply you with concrete dockets from the supplier? then you could work backwards on the lineal meters. But 100% you should have been told about the extra! Our contract (NSW Fair Trading template) has 0 Provisional sums so we didn't expect any unforseen cost. But instead they raised this as variation without our consent and without even inviting us to be onsite to check prior to slab pour. They can't seem to provide any evidence besides the cdc engineering report which they said it usually more than what is in the report come the actual piering onsite. Still, we ask for proof which they can't provide. Another thing is they raised a variation for BAL 12.5 related works and materials. They are charging us for variation stating this is unforseen which again we are disputing with them. Prior to us signing the contract, the BAL rating of the land is already a known fact.The thing is there is never a mention of BAL related works and materials in our contract and tender neither does it say that it is excluded. We presume that this is already included in the fixed price contract as BAL related works and materials are part of the builder's compliance with the council's requirement(not us).
