After some advice.
Based in Sydney - I'm wanting to use CDC for development. There are a number of protected trees on my site that I would like replaced and some kept. This will require me to put a request to council which I suspect will just get rejected.
Therefore I'm considering compromising my design to accomodate the Trees and then go with CDC and get approval. My question is what happens if existing trees are then damaged in the future for some reason beyond my control. I.e. the roots are damaged by the builder....
I am liable to be sued...?
Advice I am being told is that as long as you are not within 3m of the tree then you can build. If something happens then I am not liable.
