So our neighbour has extended his bathroom against our boundary (zero lot extension). I had to agreed in writing and on plans they were never meant to encroach our property boundary and he it was ok for him to remove the fence, with the wall being the new boundary. After the construction of the extension, the footing/foundation overhang has encroached our property boundary by about 7cm in width and 2m in length(side fence), like a small slither of a rectangle. Whilst I understand this may be negligible I am aware of the issues surrounding future potential issues in Adverse Possession of land if the structure is held there for longer than 15 years and 1 day. We have tried to politely requested for it to be reverted but I'm really sure how easy it can be done now that it is constructed to basically grind off about 7cm worth of concrete. Fearing the worst in the event they cannot do this, what would you guys suggest the best approach is without p*ssing my neighbours off but also on the same token I don't like to be short changed over? 1. Whilst I understand it pretty much isn't prime real estate, it annoys me they stuffed up and didn't keep to their agreement of respecting the current boundaries. Secondly, I'm anxious about any future fencing screw ups where potentially they can move the entire length of the fence over by the said 7cm (40m) - unlikely but could potentially happen. 2. I could sell off/make it an easement requesting for compensation but honestly at 0.14m2 x say the market rate of $1,500 per m2 here, it would be a $210 compensation. For that I'd guess I'd need to fork out lawyer fees on top of surveying fees which would well be beyond this. 3. I'd preferably want a restitution i.e. removal of the overhang, it doesn't have to be cm precise and probably wont happen but current it is seriously annoying. However, what are the chances of this technically speaking, how difficult is it to do so? Some sources online basically says its just a matter of a concrete grinder being used, my non professional self tells me it isnt that easy? At worst I can live with it being there but obviously don't want to lose the slither of land if the 15 year expires. Thanks.
