My builder took more than 3 months to finalise the design, complete structure design, Bushfire and Sydnbey water approvals. He was ready to submit for CDC approval and the certifier reverted back saying that we cannot build second storey up to the fence. Let me explain my plan. I have left 1.3 m easement space on one end and occuping upto the fence on the other side. Now the builder says that the certifier denied to accept the plan stating that the first storey should have an easement of 1.3 meters on either sides. This is causing a narrow width on the first floor and taken away all the charm. CDC seems right to me, but I do understand uour dilemmas, unfortunately, if you didnt agree with CDC, you need to go through DA hoping DA will approve it. Otherwise, its a waste of time. Either way, your neighbor will need to approve it as well. If your neighbor reject it because of your first floor too close to theirs, they can reject it and you wont be able to build. I have been with them for a month now but the horror stories of 3 months or more, i would then embrace to pay monthly penalty to my builder to keep my price intact. So right now, my one side is 700mm away from boundary, both ground and first floor. But since its less that 900mm, its considered zero lot and i cant have windows or any opening on that side.
