Yes the neighbour could not be contacted due to mentioned reasons, their build is getting to completion now they are about 3 months more into moving. Fence Erected: Mar 2017 Neighbour land title : Sept 2017 What should I have done wait till September for them, when the land titles it is then only the council releases their details to be contacted in serving notice, prior to that the developers have details but they refuse to give details because of privacy laws. Re: Fencing - Neighbour doesn’t want to pay for fencing. 4Feb 08, 2018 8:52 am Your neighbor at the time of putting the fence up was the developer not the people who eventually bought in September. Did you try chasing the developer when you put the fence up? Re: Fencing - Neighbour doesn’t want to pay for fencing. 5Feb 08, 2018 8:54 am There should be some recourse through the local council? Shared fencing is one of the biggest causes of conflict between neighbours. We have built half of our fence and will build the rest shortly, we have chosen a fence that is built solidly and to our specifications. In the end we probably won’t chase the neighbours for their share, but you are more than entitled to. It’s a tricky situation to be in and I really don’t envy you and unfortunately don’t have much advise. I hope you get the resolution you are hoping for Re: Fencing - Neighbour doesn’t want to pay for fencing. 6Feb 08, 2018 1:09 pm LargeB Your neighbor at the time of putting the fence up was the developer not the people who eventually bought in September. I m sure 10% deposit was paid at the time of release and already had contract signed, its just when it titles the ownership in papers transfers to the owner. It is not much of a money but the way wanting everything for free is certainly going to affect how it was, and how its going to be as neighbours. I can’t get over it Re: Fencing - Neighbour doesn’t want to pay for fencing. 8Feb 08, 2018 1:38 pm We went to Small Claims Court years ago for something similar. Costs nothing but they can award costs if it costs you something. So long as you have the paper work and go through all the channels. Make sure you ask for it in writing and keep any replies - or note them down - dates etc. It may take 6-12 months but you will win - just lose a neighbour. I'd suggest doing it. They are just being lousy. Re: Fencing - Neighbour doesn’t want to pay for fencing. 10Feb 08, 2018 3:05 pm Its a weird one. My understanding from my own fencers was that until the land titles, basically no one seems to be responsible for the other half of the fence. Even though I moved in last of my neighbors, I paid both invoices for fencing as soon as my neighbors fencer sent them through (even though the fences are crap). Behind I tried to arrange myself, but neither of the two neighbors I share with responded, then one of those neighbors sent through their own notice that I agreed to go ahead with, and I had to accept the other neighbors share since they still weren't responding (they hadn't started building, but land had titled). Thankfully just as the bill came due, those neighbors paid their share. I feel for you, but not sure if there is any legal recourse? Id certainly not be offering them a cup of sugar ever. Hope you get what your owed. Fencing - Neighbour doesn’t want to pay for fencing. 11Feb 08, 2018 6:04 pm I m wondering to tell them that I ll break the fence apart then go around and look for fencers, its my fence i paid for it so I should break it damage it do whatever I want, because that is how you deal with it. Re: Fencing - Neighbour doesn’t want to pay for fencing. 12Feb 09, 2018 10:00 am I have got something similar. Me and all my neighbours are building but are in different stage. we will be moving in hopefully by the end of this month or early next. I have been trying to get hold of them since November 2017. Only one has got back to be and said ok. I have sent 2 letters (1 is registered post) to rest two of them with the quote. I have even tried to pass on my contact details to their site supervisor but no response at all. Some one tried to break into our property during this time. So I had to do something to protect our property. Last week, I went to knock on one of the neighbour's current address and with all intention to talk about how urgently we need to commence fencing. No one answered the door and found out later from their SS that they are on holiday. That is that. Next week, I am going to other neighbours home. I don't care if they find it rude. I will hand them my contact details and quote and let them know how madly I have been trying to get in touch with them. This is the only option I have left. Re: Fencing - Neighbour doesn’t want to pay for fencing. 13Feb 09, 2018 4:29 pm I don't think you have any recourse to get any reimbursement for the fence, I think your best bet is to nicely ask current owner if they will contribute to cost of fence. You are indeed entitled to do that. State fencing laws state each owner must contribute to the fence. The current use of the land (vacant, farmed , etc) is irrelevant although I can see a possible exemption for a developer. The praticality of the situation is, unless the owner has a dwelling sited there and it is occupied by himself or tenants, your requests for payment will be fobbed off endlessly, simply because they know it will be too much trouble for you to pursue them. In these cases you have 3 options
You appear to be ensconced in option 3. are going to be fobbed off endlessly titled holder is either living therregulations do not usually state that one title holder must be using the land for any particular purpose.
