Browse Forums General Discussion 1 Feb 26, 2009 11:34 pm My builder, Meletis Homes, has built my house in the wrong spot (he and his lawyer have acknowledged this). I want to lodge a complaint against Meletis Homes here in Victoria. Can anyone tell me how to do this?

you say the builder has acknowledged the mistake, but didnt say if they were offering any compensation at all. Also, how bad is the mistake? By this I mean was the house built 100mm from where it should have been or 5mts.. or was the orientation wrong by 3mt ? Personally, I'd look at mediation first before heading to VCAT, alot less expensive and confronting for the people included ( no court room situation ). It's a bit of a loaded question and to help you we need for information... (some of these are a repeat of charlie's) * have the builder/lawyer acknoweldged it in writing? * was there any compensation offered? * do you want to make a complaint to Meletis, or an external body? * who in Meletis made the acknowledgement? * how bad is it? Does the house need to be pulled down or can you work around it? If you can work around it, how much will it cost to put in the workaround? * have you tried any sort of negotiation or mediation as yet? etc. etc. After 2 false starts, a year living overseas, two more world trips and 3 years of uncertainty we are now starting the build process again - hopefully for real this time! I'm sure they are required by law to provide it BACV i think this is the name ? I threatned to use them when building with H*****y were quick to organize site meeting and sort out issues. Re: Lodging a complaint against builder - Meletis Homes 8Mar 05, 2009 9:18 pm Meletis have offered us some compensation for the incorrect positioning (and we're talking 800mm here further back from the front of the block) but we really had to push them hard to get them to come to the table. They essentially went straight to their lawyers and the principal refused to talk to us directly. We therefore had no choice but to talk to a lawyer also and it seems all advice was to try and mediate before you get to VCAT.
Now we've got the offer, we still want to make a complaint so that people learn/know to look out for this kind of defect. Appreciate all the feedback. Re: Lodging a complaint against builder - Meletis Homes 9Mar 05, 2009 10:03 pm If the compensation is acceptable I would just accept it and move on.
