Our neighbour has built a retaining wall and concreted his fence 150mm on to our land. He did not get permission from council for the retaining wall. (he only built it after we bought our place and he did not communicate with us) When we move in we have to get it surveyed. The new owners are not going to be impressed. But yeah, it is not an issue with the builders. I'm pretty much going to use our contract and see where that gets us - no mention in the contract that the gate post would have to be removed, just the paling boundary fence. We've just returned from looking at a Metricon KDR around the corner from us - they're not even building on a zero lot boundary (about 150mm setback), and their garage guttering is the same as yours. I think their building surveyor has stuffed this one up; as it should have been picked up at plans stage.
