Browse Forums General Discussion 1 May 24, 2017 6:32 pm Hi all, Got a hard one - have read over contract and the HIA rules but its just not clear. We received our FIXING invoice. If we pay this we will only have 10% left to pay. The plaster, skirting , architraves and cupboards are done as described in fixing stage. The contract also says - basins and baths (which are not done). Everything looks great and seems to be going really well. NOT completed: * flooring / carpets * bath * shower * floor tiles * wall tiles * $20,000 air con * $15,000 septic * paint * concrete paths and patio * driveway Should we be paying this fixing stage? If we do, we kind of have $100,000+ worth of items to go in and barely $40,000 to pay. It concerns us that we would not be covered. Works slows down on site and projects drag on 2. 90% of the contract funds has been used while 30% of the work is still to be done 3. Builder relies on new front loaded projects to finish your job off (these also slow) 4. Builder is hassling you for payments, Subcontractors & Suppliers aren't being paid on time 5. Builder eventually runs out of funds & pyramid collapses You should have been given a drawdown S-% Curve on the contract price for the various stages and it should have been properly checked by the lending banks....unless the battlers don't borrow much, then some builders use their funds as a cash cows. You better get onto it quickly...Goodluck OT With the accurate Building Information Modelling (BIM) software that is used today to Design,Engineer, Quantify & Cost projects , Clients & Banks should insist on data & accurate Building Stage Costings (S-curves) from an independent source, proper inspections are a must & don't release funds until the stages have been fully certified, NO EXCUSES,NO DEFECTS, NO PAYMENTS Designer,Engineer (Civil,Const & Envir),Builder,Concrete & Masonry Contract.Struct Repairs Re: Payment of Stages - 90% paid... so much not done (help!! 4May 27, 2017 7:53 pm I was in a similar boat. If you paid $20000 for aircon remember builder is making profit. You still have a HIA contract for completion by a specific date. Before you pay fixing all fixing items in contract should be completed. So sounds like that is basins and baths for you, ? Paint at least most of it. If they push you to pay earlier see a lawyer Putting some things like flooring in last may be a blessing as careless trades less likely to damage before completion. Ask for a private inspector to come through for stage completion if you need back up as builder is being pushy.
