Am surprised department of fair training wasn't able to help as your contract with the builder was broken by placement of the house in the wrong location . They are trying to bully you and protect their reputation. I think good legal advice is in order. I am honestly surprised about how unreasonable council are being. Out of curiosity do your neighbours have a problem with your existing window locations or is that simply council? I would have thought there was an appeal process. I feel for you.. sorry to hear about this.. but this is what I will do: Firstly check if the surveyor is registered, if he is registered, he is clearly incompetent and should not be allowed to practice anymore. I will lodge a complaint against this surveyor with the board of surveyors. e.g. http://www.bossi.nsw.gov.au/ Secondly, you have already gone to the fair trading for advice that is good. Since the house is already built nothing much can be done but you can come up with a list of outcomes and what you want to achieve and get a tribunal order so that your builder can comply. Eg. Builder to pay: for surveyor fee for fence relocation at their expense for water tank relocation at their expense etc.. It may seem a lot of work to do but in order to achieve the outcome you have to push on ..else.. the builder won't care... good luck Re: Frustrated with Masterton 14Jul 08, 2016 10:49 am hi all, thanks for the advice. We have calculated we are missing roughly $3000 worth of land )based on 2014 prices), we wonder what the value of this land will be in 20 years when we decided to sell and move??? Combined with your current and future out of pocket expenses, your loss is substantially more than $3,000. Re: Frustrated with Masterton 17Jul 28, 2016 12:41 pm Hi all I am new, Our_home i just read this posts and have problem with M too, they changed our plans and lodged to cdc without informing us, we only noted when pre CC email CDC approval plans to us and also they created 2more variations that cost us almost $10000 more, we want complain to fair trading Any one please give us advices do builder have right to change plans and documents to lodged in without client consent. Can we ask for our money back because of their incompetencies? Our_home how is the process you complaint to fair trading and NCAT. We also thinks about going to social media talk back shows to ask for advices form listeners, have you do this yet.I know very frustrated with three school kids too. 4 16990 |
