Browse Forums General Discussion 1 Dec 09, 2015 4:34 pm Cutting the story short My build is towards the finishing stage, but builder been extremely slow to finish off work . Contract 165 days. Now is been 320 days. Now he doesn't pick up my call, doesn't provide a schedule since 5 months ago by email or writing....(prob protecting himself for evidence as agreeing to complete job by certain date) Now some work is outstanding , decking+ fence+ kitchen appliance. Rang master builder, master builder just said to contact a construction lawyer which is prob faster. (Not very helpful, prob at this time of year,they are just looking forward the holiday break) What should I do? Best way to push him along ? Lawyer is the way to go? Or will QBCC do something more than Master Builder.? It's just that his ignorance to my call and sms and email is pushing me and my wife to the limit. Anyone with experience with a bad builder and has a good solution outcome, please help . As serious problems generally contain poor quality ,I personally rate workmanship and a quality build 90percent of the build, speed is good but means nothing years down the track. Moved in, withheld last payment, told builder to get f*#ked. Legally not allowed to do that right ?? Plus I only owe him less than 10k as I have been helping him out with paying all the deposit for all the stuff. His financial management is very bad, so is project management skill. As serious problems generally contain poor quality ,I personally rate workmanship and a quality build 90percent of the build, speed is good but means nothing years down the track. His quality was good at the start. But Becoz,he start to run out of money, he is overlooking whatever he can. I even have to fork out money to fix his shxt to get the certifier happy and give me partial form 21. Quality of final stage is far from par. They were prepared to take them to court anyway. No point fighting over $20k when it would cost $10k min to win. I think from memory the standard Master Builders contract clause says $50 per day unless you nominate and agree on a different figure. If not yet then hire new contractor for rest work. didnt' sign any paper for the variations. Only for the actual house build. But both variation and the house is taking a while. Paid all the variations in full before work commence So far only about 10k remaining I have not paid him. Had to keep on feeding him money otherwise he can't continue to finish his work. But when we were 3 months behind schedule, he came up with some BS about weather and material that I supply was late and it adds up to 3 months already. To me that's just full of BS. at $15 a day, prob he is not too worried I guess. I am not too worried about the figure, just hope he can finish the work and get out of my life.
