Just looking for some advice fof my brother.
His neighbour on the back fence recently came round with a survey which apparently shows that part of his rear garden is their land. He only bought in the last 2 yrs and the hedge/ fence are so established that they must have been there for several years/ decades. He has spoken with the conveyancer that was responsible for his purchase , who at this point is refusing to take responsibility and manage the issue. He has affectively said my brother either needs to pay for the land or give it back. As an aside the conveyancer got in touch with the neighbours solicitor to ask how much they were looking for and apparently they have a valuation for $76000. That seems high to me though as the land is over an easement. it could never be used to build on so could only be considered as garden space.
Any suggestions? He would rather not have to take his conveyancer to court. But ultimately he paid what he did for the property based on sold as seen. So he wouldn't have paid that much if the garden had been that much smaller.
