But zero boundary or not, I would think that if a neighbour needs to pull a fence down for any reason other then a faulty fence etc, then the costs should be from the person pulling the fence down. Sounds obvious to me, which isn't always the legal way, but I wouldn't think the builder has a leg to stand on. I'd outright refuse and ask for him to show you legal proof that it's your responsibility. Where their garage meets the zero boundary is next to bathroom and bedroom windows so for our own privacy we didn't want to wait. Hey HoudaMan, Yes I guess that's where my understanding and logic stands too. Basically the SS is now saying it is nothing to do with him and is between myself and my neighbour, but I think it has everything to do with him given he needs the access to proceed with the build. I called our site manager today and he is completely on our side and says that he would not go about things in that way and he would only remove the fence as an absolute last resort and would instead brick from the inside of the garage. It must be sucks when their SS asked you to cover all the cost like that is your fault. Have you talk to your neighbour about this? Re: Anyone building at George's Fair, Moorebank? 6078Jun 24, 2015 8:51 am We also went through the same thing and even spoke to the owner who didn't want to help in removing the fence even though they also paid for part of it. So without support from council and anyone else really, we removed the fence and posts and had to also close up the gap ourselves, it just shows what kind of neighbours we will be getting next door.
Mind you we now have to redo that area on the side of the house and purchase a new gate. If it was me building 2yrs after my neighbours have built i would of offered to help remove the fence/posts and help close the gap, but not everyone is nice.
