Browse Forums General Discussion 1 Nov 02, 2008 11:16 pm Can the builder refuse to fix the issues that you raise after pre-handover inspection?
We had a walk through last Friday (unfortunately Kev couldn't join us on that day and he will do his own this Wednesday - 5th of Nov) and realised, after checking some of our builder's display homes, that some items were not as good as the ones in their display homes. Can we still raise these issues? Also, our SS said that the issues that Kev will raise this Wednesday will no longer be honored (or fixed), unless major, because we already did the walk through and only those items mentioned on the list (that we signed) will be fixed. Was our SS right/telling the truth, or just trying to scare us? Just thinking that it would be a waste of our money to get Kev to do another inspection when our builder won't fix the issues that he would raise anyway. Please advise. Re: What if we raise more issues after pre-handover inspection? 2Nov 02, 2008 11:53 pm Hi VJ,
No experience about the issue as I haven't build yet but I think you should check the Pre Completion Inspection paper to see if it contains any clauses or condition of PCI, then call up Kev to ask for his opinion and BACV to raise your concerns and see if the SS is right or not. If still not satisfied than you could call the general manager and voice your concerns. Don't listen to SS as they just want the house handed over as soon as possible so will say anything. Wish you all the best. Re: What if we raise more issues after pre-handover inspection? 3Nov 03, 2008 8:02 am VJ.... what was the reason you signed the list... and what was the wording of it? If it states something along the lines of it including all defects..... blah ablah blah and you signed it... then it might be more difficult to argue that there is actually more wrong.
Were you pressured into signing it? I leave you to fend for yourself, figure things out yourself. Terrence Malick Re: What if we raise more issues after pre-handover inspection? 4Nov 03, 2008 8:44 pm VJ, we didn't have any problem getting things fixed as they arose after signing off the inspection, things like leaky shower bases, water connection coming adrift from the tap, central heating not being commissioned yet etc.
*But* Mind you, these were real problems, I don't think you will have much luck with things that simply don't look as good as in the display home. Geoff - Decophile. Re: What if we raise more issues after pre-handover inspection? 5Nov 05, 2008 9:04 pm Thanks for all your responses.

Need to know if our SS was just trying to convince us that those issues were within tolerances... Quote: VJ.... what was the reason you signed the list... and what was the wording of it? Were you pressured into signing it? joles, we signed the list because we though we need to sign the list .. that is just documenting the issues that we found on that day. however, i didn't see anything in it that says we can't add any further issues. anyway, i already emailed Kev our concerns and he said he would look into the issues and talk to our SS about 'em. Re: What if we raise more issues after pre-handover inspection? 6Nov 05, 2008 9:31 pm VJ,
If Kev finds issues ... they WILL fix them. The paper you signed means very little. Dont worry yourself about it. Re: What if we raise more issues after pre-handover inspection? 7Nov 05, 2008 9:37 pm Thanks Matt.
We just got worried when Kev wasn't available during our walk through last Friday and SS said they will only fix the ones that were raised on that day. Kev did his inspection today. ----------------------------------------------------------------------------------------- Built the Nevada 42 Next project - landscaping! Re: What if we raise more issues after pre-handover inspection? 8Nov 05, 2008 9:38 pm Excellent!
Did he find much? (that you can discuss?) Re: What if we raise more issues after pre-handover inspection? 9Nov 06, 2008 12:16 pm He hasn't come back to me re: the inspection (and we haven't even paid him because none of us went with him during his inspection).
Our settlement date is next Friday, 14th Nov. so hopefully he could give us the report within the next few days. Will let you know the result of his inspection. ----------------------------------------------------------------------------------------- Built the Nevada 42 Next project - landscaping!
