We were ment to have footpath removed but they stuffed our paperwork and then we were told our council had been rejecting lately and cause we had so much delay we just left it and didn't bother fighting for it. If your builder is not doing driveway then Im pretty sure you just need contact council about getting permission and so on. Footpaths are council property as its on council verge, as far as I know land developers don't have much to do with it Ive even seen people around here whove had curb removed also for their aggregate driveway.
