Our PCI should be in about 10 days time and I had a meeting onsite with the site supervisor today that uncovered a possible problem for PCI.
We have an upstairs deck that has been stained, and someone appears to have left a piece of ply sitting on the deck for too long (this is the story by the SS and it seems to make sense). So, what has happened is the sun has faded out the timber around, leaving a clear rectangle mark in the stain on the boards (almost the size of a door). I told the SS that it needed to be fixed, and he said he had talked to 2 'experts' who had said that in a month or two the rest of the boards will fade and you won't notice it anymore. But, as I said to him, why should I move into a new house that already has issues??
Anyway, said he wouldn't do anything about it and he wouldn't budge and I know the managing director of the company will back him, and do as little as he can to get the final payment from us.
So, I know the easy answer is to just not pay and not except it, but then I read this
http://hia.com.au/hia/content/Builder/region/National/classification/Workplace%20Services/Contracts/article/IS/WS/ACT_practical_completion.aspx
(Sorry, hope the link worked)
So, from reading this, we can dispute the matter. They can send us a notice disputing us and then we still have to pay within 5 days?? How can that be right??
We have a standard masters builders contract if it makes any difference.
Any advice would be appreciated
