If the builder doesn't agree to fix something that you think is a problem, I'm fairly sure you can go to a consumer tribunal to resolve the matter. Have another read of your contract or maybe there is something on the fair trading website about it. Once builder knows you have a professional looking after you then attitudes often change for the better. And no, you are not necessarily stuck with it because there is a range of warranties that need to be satisfied. Also your inspector could pick up other issues you are not aware of. Hardly worth withholding payment over. What the builder is saying does make sense. Not really worth like sanding back the deck and re staining when its just going to sort itself out. Unfortunately it is our main entertaining deck leading off the kitchen and is immediately obvious when you step out. Our builder certainly seems to have pci sussed to his own advantage. Pci is booked for 5 days after notification (the day any defects must be notified to them by) and they refuse to allow the inspector to walk through with us. They will only let them in after we have done pci with them, and presumably they have tried to rail road us into signing only the defects we pick up. Seems not much we can do about it either. The builder is trying to con you. Read your contract carefully. In Definitions you will find that "the Owner" means You, and your agents (Your inspector is your agent) In the main Contract you should find a heading about 'Possession' = This normally allows the "Owner" (which includes his agent) to inspect the Building Works at Reasonable Times. I would suggest you Write (not fax or Email) to your builder saying you and your agent will be inpecting the site when you want to do it.
