In a few weeks time, I will be tendering for a block of land. If I am to be successful, would you recommend anything for me to be included in the contract of sale or anything specific to look out for? Any questions I should ask before I put my tender in? Land (1 acre) is to be cut into 13 blocks to be sold, and I will be tendering for 1 of them. THanks Hi, We did sign up for another block of land, same town, different estate. This time our conveyancer did include a sunset clause of 6 months, so if titles are not release we at least can get out of the contract after 6 months. This means we are not wasting another year....... Cheers DD Re: What if land does not title within 18 months 12Sep 20, 2013 8:09 am At what stage do you get your conveyancer to add the clauses about 6 month sunset clause and subject to bank finance/valuation? Do this before you sign the contract. In fact look to add in or amend any of the clauses prior to signing. If they are not going to budge then you need to decide if it still represents value for you. EG they might only agree to a 12month sunset clause in which case you may reduce your offer. On sunset clauses also be clear on the wording - you just want to get out after that period. Some will try and say things like, the sunset clause will only apply so long as the delay has not been caused by them, if its caused by another body (say power or water authority) and they are taking their sweet time, you are still bound. Obviously you don't want that. The last point is that most vendors won't agree to something they know they wont be able to meet or get close to. So if they are coming back with a "no, we never change that clause but we'll be on track for that timeframe anyway so just sign" you can pretty much bet they have no hope of meeting it. http://camdenbuild.blogspot.com.au/ by invite only please pm me Re: What if land does not title within 18 months 14Sep 21, 2013 12:19 am robbie55 Do this before you sign the contract.
