At the moment we are looking at different block's of land, same town, different location and developper. Titles where supposed to be released Feb 2013…… To date (July 2013) nothing has been done, no progress, or an application with the council, nothing. We are not able to get an answer from the developer or his conveyancer about when they expect titles to be released. Is this common practise?? There is a possibility for us as well as the developer to get out of the contract after 18 months. Is there anyone at this forum who has done this? If so what where the disadvantages? Just a bit more info, we have not signed any other contract than the one for a block of land. The 10% deposit sits in an account from a local real estate agent. At this moment 3 out of the initial 10 blocks are sold (4 additional blocks will follow, 2nd fase). Thanks! Hi DD, Sorry to hear about ur situation. This time our conveyancer did include a sunset clause of 6 months, so if titles are not release we at least can get out of the contract after 6 months. This means we are not wasting another year....... Do this before you sign the contract. In fact look to add in or amend any of the clauses prior to signing. If they are not going to budge then you need to decide if it still represents value for you. EG they might only agree to a 12month sunset clause in which case you may reduce your offer. On sunset clauses also be clear on the wording - you just want to get out after that period. Some will try and say things like, the sunset clause will only apply so long as the delay has not been caused by them, if its caused by another body (say power or water authority) and they are taking their sweet time, you are still bound. Obviously you don't want that. The last point is that most vendors won't agree to something they know they wont be able to meet or get close to.
