Browse Forums Building Standards; Getting It Right! 1 Jul 15, 2013 9:17 pm Hi Our neighbours have started building their house but I'm concerned the garage has been built right up against the fence. When we built (2 years ago) it was a requirement that the house wall was at least 1m from the fence as we had to move our house over a little. We also had to add Eves. Wife called the council and there doesn't seem to be requirements anymore they said. We have since contacted the land developer but as the estate has been handed over to the council I don't like our chances. Any else had an issue like this? Re: Land developer requirements handed over to council 2Jul 15, 2013 9:49 pm I am sorry, but what exactly is the issue? ______________________________________________________________________ Signed up Jan 2013........Almost done! Issue is the neighbours house is currently being built and their garage is right up against the fence. One of requirements for the estate was there had to be at least a 1meter gap between the house bricks and the fence which they haven't done. The land developer has been handed over the estate the local council so i assume the same rules no longer apply when the land developer was in control. Re: Land developer requirements handed over to council 4Jul 15, 2013 10:00 pm It really depends on whether the restriction you mention is A developer rule - which can expire when all the blocks have been built or It is a restrictive covenant (see http://www.anewhouse.com.au/?p=139) in which case its up to you to take action. (Most councils only controls are planning controls, which generally permit limited building on boundaries) The Harder You Try - the Luckier You Get !
