Context *purchased a property with a main house and semi-converted garage with existing bathroom and kitchen facilities *completed the garage conversion to a nice little one bedroom unit We are now not sure if the semi-converted garage was ever given a building permit, because it is not separate title, separately metered, no rates etc. We are planning to rent it out but want to be safe. Have requested copies of permits relating to property but will take 10 days... When you bought it did it say it was a granny flat? or can be STCA? They are careful not to advertise a granny flat unless approved. If it WAS approved I'd assume they'd say that. Can't believe you didn't ask. Does it look like it complies? Will it comply? If so probably worth getting it compliant. Garages can comply but the problem is usually head hieght and floor waterproofing membrane (which most garages don't have). Also if it joins the house it needs to be separated by a fireproof wall. I'd just wait for the permits. If it's not legal council can ask you to remove the kitchen. Post again if you need more help. I've just separated a house into house and granny flat . Firewalls are a pain. Many people rent illegally but it is a risk. If there's an accident you lose everything. My mum is a registered builder so we checked it thoroughly and it was advertised as granny flat and potential subdivision potential STCA. But now it looks a bit uncertain. I have requested permits from council, it doesn't actually have a kitchen, only cupboards, no gas or electrical stove. IT does have a full bathroom.
