Browse Forums Home Finance 1 Nov 20, 2010 7:12 am We are building a unit (1 of 27) off the plan ...all was going fine until we were given notice at our rental property unexpectedly as owners want relatives to move in ... we will put our furniture in storage for 1-2 months while we house sit till 3 Jan, but after that we have nowhere to go ...however someone has mentioned we can rent the property from the builder/developer prior to settlement ?? This would save us from having to find somewhere for an unknown time in January and also from 3 moves in 2 months !! The build is expected to finish sometime in January ... So has anyone done this or heard of it ?? Apparently its quite legal (have contacted solicitors but still awaiting a call back) Jude Re: Paying rent to builder/developer before settlement ?? 2Nov 20, 2010 7:20 am Generally the minute the house is declared "finished" the builder will be organising for settlement. They were still doing small touchups from things they found at the PCI on the day before I paid my final check and got my own set of keys. Builders want to get jobs over and done with as fast as possible so they can move onto the next one. Have you tried talking to your agent about the possibility of extension to your move out date. I know many people that have been able to negotiate with their landlords to allow them more time. The other options is the tribunal - who generally don't want to see people homeless and because you have a clear time that you actually want to be out of your rental property and into a new one it's highly likely they will side with you. Re: Paying rent to builder/developer before settlement ?? 3Nov 20, 2010 10:14 am Thanks Jayney ...landlords have said no extension to lease as they have relatives coming from China and want them to live here - they've given us appropriate notice so no come back with tribunal... we have a friend who possibly can bed us but not our dog which causes different issues ...plus she lives miles away and my son is not yet driving and starts work at 5.30am and needs public transport... Builders certainly want to get finished and paid - 27 units !! However apparently if its only a week or two to settlemnt it is legal to pay rent and move in early - doesn't affct your warranty etc... this is what i have been told by a friend who has some experience with conveyancing ... hoping for someone who may have done this or know anything?? It's doing my head in trying to figure out what to do. We desperately want to get out of where we are and have the offer of a house sit for relatives for 3 weeks. There will be a gap of about 2-3 weeks before house is finished and can't really stay on with relatives when they are back and can't afford motel/serviced apartment etc. Was thinking of asking builder to move in (just suitcase/temporary bed), while tradies keep working. Don't care if appliances are not in etc. Just need electricity/plumbing to be finished. Don't even care if flooring not finished. Sorry to hijack. Its all been drawn up legally through our mutual solicitors : the unit is completed inside, they are working outside and on other units and still need to landscape - gosh what a relief l Ardo That is so funny!
