I used my home builder's in house mortgage broker to apply for my home loan as I thought it will probably be easier (how wrong I was). From the beginning, I had this gut feeling that something was not right, they sort of didn't know what they were doing etc, they had terrible staff turnovers - there was always new dealing with my case, incorrect information was given to me about how FHOG application worked and my FHOG forms were somehow sent to wrong place etc. My broker never ever told me that there will be no FHOG ready at the time of settlement and I had to have that amount ready in cash. Due to delays in settlement in looking for a wholesale loan company to fund my FHOG for settlement, the bank is now charging me around 2.5 K of interest. Now my question is, shouldn't the mortgage broker be liable for this , as they have been negligent by not planning and advising me about this earlier knowing my situation ( I had no cash to fund my FHOG). Even after asking numerous times what I was required to do to be ready for settlement, I was told everything has gone fine and it will all be okay and settlement will happen on the due date.
I am thinking of getting a solicitor if they don't own up to their mistake and reimburse the amount I've had to pay for interest because of delayed settlement. Has anyone gone through something like this?? any advice will help, appreciate it.
