Browse Forums Home Finance 1 Jan 03, 2010 11:58 am Hi, I'm just wondering if anyone has applied for the FHOG extension because the construction date was more than 26 weeks after the contract has been signed. We signed the builder contract in early-May 2009. Unfortunately, our land was only settled in late-Nov 2009 and our builder can only start the construction by late-Jan 2010 due to the Christmas and New Year break. Therefore, we need to apply for the FHOG extension but not sure when we need to do this. We have been advised by the land sales person when we purchased the land that the expected land settlement was in Jun/Jul 2009. But now the settlement ended up in late Nov 2009! Will the SRO grant us the extension for the $26k FHOG? Do we need a letter from the land developer to prove that the delay was due to unforeseen circumstances e.g. weather, delay of earlier stages, etc? May I also ask when we should send the letter to SRO to request for the extension? Is it the time when the bank submits the FHOG application for us? Or only when SRO asks us for the reason about the construction delay? Much appreciated for your help!!! Thanks!!! Metricon Amira Re: FHOG extension 3Jan 03, 2010 11:43 pm First off, don't panic Theres a few posts on this topic in the forum. Basically so long as you were'nt purposefully delaying it yourself, that it was due to council/land titling/developer delays, after you apply and get declined for the boost part (this is the bit which has the time limit), you respond with a letter and from what I can see they approve it on a case by case basis, hav'ent seen any posts where it was declined. I'll be going thru the same thing myself. My land was supposed to title Mid October. Then November. Then December. Now they're saying it own't be ready until late january. i need a slab down before 30th March... likely i'll be writing a letter myself in the coming months. Oh - i believe you'll need a letter from all parties. builder saying why they could'nt get the slab down, developer saying why the land was delayed. Re: FHOG extension 4Jan 04, 2010 11:22 am kikin Anyone who can help us? We do need your help. Any suggestions should be helpful. Thank you so much!! G'day Kikin, this was discussed between myself and various other users over in the Alamanda thread. I'll just paste what I found. Hi Alamandone. Just a follow up and what I have found so far. I have spoken directly with the SRO and also Jeremy at Oliver Hume. From what has been explained to me, I need to do the following: * Obtain a letter from the developer (Villawood) stating the reason for the title delay from the original date projected. * Obtain a letter from the builder (in my case H3nl3y) showing that my contract was signed and ready to proceed if the original date were to go ahead. Supply both of these in writing to the SRO with a cover letter explaining the exact situation. For example; I was assured that titles would be ready in december when I paid my deposit for the block. I had signed my build contract on the 22nd of september so that I would be ready to proceed with the build and meet the 26 week deadline. Due to the developer delaying the titles which is an "unforseen circumstance" and beyond my control I will need to apply for an extension to the allowable time to fulfil the criteria obtaining the full FHOG. Please note each case is reviewed on an individual basis and there is no gaurantee. However having spoken to the SRO rep and Jeremy they do look favourably on this. Perhaps best getting in touch with the SRO yourself and speak to Oliver Hume to get the ball rolling. This way you can make sure you are covered and can afford yourself some peace of mind. Hope that helps. Building Charleton 283 with Henley.
