Browse Forums Old Home Restoration / Renovation 1 Mar 26, 2020 10:44 pm Hi, We're in the process of seeking council approval for home renovation. The house is 2nd from the corner. House backs onto home from next street. There is a large council park at the end of nect street. The property title shows an easement that runs the length of the western side of the block (front to back and currently a driveway). The easement is clear and so we're requesting the removal of it. Council requested we seek approval from south east water and Melbourne water, to which both approved. Council easement engineer said won't give approval because they want to use our property to access the multiple properties behind us as they have easements at the back of all properties which are council assets (storm water drains) . They said its illegal for councils to access easements from the front of a property so they need our property. Questions, is anyone aware of council using your property as a thoroughfare? Is it true that it's illegal to access easements from the front of a property? You should be able to encase the sewer but you will need it designed and approved and access to lot 580 to do the work 2 17168 You might be able to apply to divert the sewer at your expense. In NSW you would contact a Water services co-ordinator and they would give you advice as to whether or not… 1 16150 Thanks - yea sounds like I need to submit build over easement application....ugh guess I better start finding someone who can do the engineering drawings 3 3387 |
