Hi,
We're in the process of seeking council approval for home renovation. The house is 2nd from the corner. House backs onto home from next street. There is a large council park at the end of nect street. The property title shows an easement that runs the length of the western side of the block (front to back and currently a driveway). The easement is clear and so we're requesting the removal of it.
Council requested we seek approval from south east water and Melbourne water, to which both approved.
Council easement engineer said won't give approval because they want to use our property to access the multiple properties behind us as they have easements at the back of all properties which are council assets (storm water drains) . They said its illegal for councils to access easements from the front of a property so they need our property.
Questions,
is anyone aware of council using your property as a thoroughfare?
Is it true that it's illegal to access easements from the front of a property?
