Good day. I was interested in a land and signed a contract with due diligence clause. Found today that there is an easement on the property but it was not disclosed in the contract by the agent or the seller.
They have selected encumbrances as NO - which to my understanding is incorrect as there is an easement.
Does this constitute to breach in contract ? Please clarify
