The seller and real estate agent are promising it is only at the back and no special construction is required . How can we be sure about it and is there any special building construction required for overland flow area? Will that greatly increase the build cost. Also in the land contract what clause should I add to protect myself if construction is going to be costly? Otherwise why risk your $ on potential hazard zone? Your insurances will be higher too. But call council or in the title search find out what is allowed in regards to Fence, Building, Structures, Vegetation, etc...
