Browse Forums Buying Land Re: Land encroachment whats the next step? 5Sep 07, 2016 7:56 pm We would like them to remove the encroachment. I understand your point. But we already sent them emails and letters through owners corporation and the real estate agent through which hey rented it out. Let me think through if we wait again. Re: Land encroachment whats the next step? 6Sep 08, 2016 7:53 am I doubt they will be willing to remove the encroachment. Have you spoken to one of the building surveyors at the Wyndham Council about the problem? How was their house approved? How much does the gutter encroach? Re: Land encroachment whats the next step? 7Sep 08, 2016 8:13 am That's terrible, I have no advice unfortunately but that will be forever frustrating if you let it go and decrease your house because of it. How did it get approved! And if there's dramas removing it that's there problem / their builders problem not yours you bought your block and just want to build on it you shouldn't have to let others use it. Good luck Re: Land encroachment whats the next step? 8Sep 08, 2016 4:10 pm Its 17cm into our boundary. Which means a lotgiven our block of land s narrow with 12.5m frontage. If we reduce ur house we have lots of issues our double garage will become a single car garage or the doors will become smaller. Aww i am worried. The council said its not their thing. They just see the building something liek that. I intend to call again and probably talk to a different person to see how. And what i was told is that is owner and builders responsibility. Awww i am so worried now. How will it work if we sought legal actions just in case. All i want is a smooth ride . How expensive would it be. Re: Land encroachment whats the next step? 9Sep 08, 2016 4:39 pm Sriya They just see the building something liek that. What do you mean? It is the builder's responsibility but I doubt that the builder is going to agree to do anything about it. Maybe somebody on here with more expertise could express an opinion as to whether the gutter can be removed without making structural changes to the house. You need to get some very good advice before you go down the legal road. It may cost more than you bargained for. Is there any possibility of selling the block and buying another one? Seriously, this does not look like a good situation. Another case of the building control system in Victoria failing. Re: Land encroachment whats the next step? 10Sep 10, 2016 12:15 pm So we spoke to the council again. This time they said we have all rights to remove the encroachment by ourself. We want to let the other party know beforehand. And my husband went to their place and found noone just pile of letters. Neighbors have no idea about them. He guess they have not been home for a while. The census letter s still untouched he could see from outside. About selling and buying a new land. Cost increased so much in that area now. Just do not know what to do. Re: Land encroachment whats the next step? 11Sep 15, 2016 11:57 am Sriya Its 17cm into our boundary. Apart from anything else, removing the gutter will only result in a massive amount of water flowing onto your property, not a good situation where you have bought. If they have the standard el cheapo 115mm quad guttering, then the issue is much, much more than just the guttering. Does the house have eaves? If you haven't already done so, you most probably need to have your block's survey checked. Have you sighted the builder's survey? 3in1 Supadiverta.
