We note our client anticipates registration to occur late 2018 early 2019. Our client instructed us to inform the purchaser, should they intend to rescind the Contract, our client will refund the deposit held.” It seems that it’s in the developers interests to force us to recind the contract by constantly delaying the process. What is also interesting is that my last correspondence with them they stated registration of Nov/Dec 2018 and now they have mentioned early 2019, this to me shows they have no intention of having the development registered in 2018. I would suggest you guys get in touch with other land owners in the release and put in a joint effort/letter to show the vendor you are all standing by for the registration and expect a commitment to closing this .. That'll send a message to them if they are remotely thinking of delaying this to get clients to pull out.. --- I don't have a signature - just this sentence saying that I don't have one - that'll do! We have been instructed to inform you that all documents are now with the Hills Council. Our client anticipates registration to occur late 2018 early 2019. Our client has instructed us to notify the purchaser, should they intent to rescind the contract our client will refund the deposit held." Re: Land Registration? And its owned by the developer so obviously he would be working hard to get it done before the whole DA is registered. However, the latest news is that its been approved now and we would hope for a council submission soon....fingers crossed... When I see at Hills Council, the Chile Care status is still under "Evaluation" "

I think we are all over reacting....if we think logically that Developer owns 4 lots for CC and by not registering or delaying does he not loose the income ? There are genuine issues on CC and been sorted now. So assuming that council submission happens in couple of weeks then 6wks for LPI, we are looking around dec or early next yr. Also there is no market for selling these blocks above 1.2m as Murphy struggling to sell their 40 odd lots and if i’m a developer would try to register ASAP with the current market trend. Cheers guys ! Hi. Answers below : 1. No construction can be done over an easement plus you are not allowed to do earthworks on it either (to add retaining walls or grade it etc). You are only to leave the 2m. Your building can start at any point after the 2m. 2. Hills DCP states no more than 65% (please confirm) of the frontage should be at the building line and less than 50% of frontage needs to be used as garage. If you're left with 18m (and I'm assuming you need to leave setback on a side), you'll be left with 17m. A triple garage is about 9.2m which is more than 50% of frontage.. You can ask the council for special exemption if it's not too far off from the allowed calculation. Three things you can do.. 1. Move the garages back from the building line 6m setback and advise the council it's not at building line (set it St 6.6m back for eg) , or 2, set the 3rd garage back further than the double garage. 3rdly, you can have a 3 garage space (3rd space disguised as storage or utilities) with a 2.5 garage door that you can use to access the 3rd garage space if the above 2 don't work. Hi BVN, why do you say there is no market for selling these lots above $1.2 mill ? Didn’t a block in garden view sell for $1.3 mill and one on cedar cutters sell for $1.26 mill a few weeks ago?
