I've been told by Steven that there is a problem with Sydney water I'm not sure how true it is considering that 6 months ago they were saying they have a problem with a water connection with an adjoining development. I asked Steven if the developer has a problem with cash flow and Steven has told me that their finances are in order. Which once again I'm not sure how true this is. It is starting to become very stressful watching house being built around our land while nothing is being done to finish this development off so that we can move forward and start our build. We also bought a block of land in Parkview Estate in August 2013 and we're also getting very concerned about the registration. At least it seems you've made contact with Steven because we've been unable to get hold of him even through his solicitor. We've been told in writing various dates for completion but with no explanation for the delays. More recently, we were asked to sign an extension until April 2015 for no apparent reason but the letter said that it should be registered by the end of November 2014. We're now in December 2014 and with no end in sight. We have no idea as to what is delaying completion. We understand that the land next door was sold by Castle haven and we don't see why they would be delaying anything as they are now building houses. It really doesn't make any sense at all. Does anyone know what is really going on, specially if the finances are in order? I have been asking around and have been told by a couple of people that there has been a few developers in the area that get the deposits then sit on the land so that people pull out then they can sell the land at a higher price. They need a certain amount of deposits to obtain finance. I'm not sure if this is the case with this developer. We seem to be like every one else who is purchasing a block of land at this development and are not sure what to believe. We are getting more and more upset with every day that goes bye. Things would be much easier if we were told the truth from day one. I think it's about time that we rally together and see what we can do to get things moving along. I'm not prepared to sit around for two years only to lose this land. All we want is to settle on the land and start building. We're right next to you guys and were delayed at least 6 months due to the owner not having completed the required sewerage for us to connect into. The rumour is that your developer has run into serious money issues and is unable to finish....makes sense I guess. We spoke to the contracting company ABAX and they were told to stop developing, not sure what to make. Anyway we're not being told the full story here and people have made arrangements in good faith to sell their houses, rent, etc. expecting a fair outcome.

We went out to check progress on the land last week and it seems that although it's slow, construction works have resumed. We have not been kept in the loop properly about delays, etc. Waiting for this land to register has been a painful process but it would be even worse if we pull out and end up empty handed. A greater scrutiny and regulation need to be put in place to protect home buyers. Fingers crossed. He told me if he was in my situation and was as upset as I am he would be thinking about pulling out, he also told me if I was to pull out he could refund my deposit within a couple of days. We will not be pulling out, we are in this until we settle on this land. Steven is looking to make as much money as possible on this development and is not concerned about who he upsets along the way. On a brighter note I have been past a couple of times this year and there has been contractors on site. We tried to get in touch with the vendor's solicitor and they couldn't give us an answer as to when registration will take place. We weren't aware of the drainage pipes. Are you referring to the 3 concrete pipes sitting near the fence to the adjoining estate? Anyway, last September we received in writing the request from Steven's solicitor to extend the sunset date to 30th April, which we accepted. However, we haven't received a new request for a further extension and our solictor is chasing this up to see if registration goes beyond 30th April. So does this mean that you and those who haven't received the sunset extension request don't have a current contract? Can the vendor rescind the contract? Regards, Fee123 Parkview estate north kellyville registration 16Apr 05, 2015 7:41 am Hi Fee123 I am not 100% sure where/which the pipes are, however that is what I was told that there still is an ongoing issue with connection to the neighboring property for drainage. We are having the same issue as you with the extending the contract past April, however what I am saying is that my solicitor never received anything back confirming the April extension. It looks to me that all works except the final tar surface on the road is to be laid and if what I been told is right we are waiting on the pipe connection to be resolved in court with the neighbor,then for registration we need to have all the contractors sign off on plumbing & electrical & road works if they have not been paid well we are not going to be registered. If it goes pat April my solicitor informed me that Steve can return our deposit and resell our land but I was assured we can sue him personally and take his personal assets off him for any losses. I am hoping we don't have to go through any of this and patiently waiting for this to be resolved peacefully. We aren't surprised at all by this latest development, our solicitor has worked tirelessly since this saga began in August 2013 with little response from the other side. This is just dragging on for far too long. We just want this land registered so that we can build our home.
