With the side boundary fencing needing to be set 1m back from the front of the house, obviously if your neighbours are building in line with the front of your house then fencing isn't really an issue, you just set back 1m. But what happens if one of your neighbours has their front of their house say 1m back from the front of yours? How do you then position the fencing?! Because a 1m setback from your house would mean the fence is in front of their houseline... Does it have to be 1m back from the house that is the furthest back? I haven't had any contact (or been in contact) with my neighbours yet, so just wondered what I should do if this issue arises? I am glad you understood what I meant, it was really hard to put into words! The 5.5m is the minimum setback for the driveway, so you could have it set back 5.5m, 6m, whatever you want I guess! Item 9.8 (a) of the MCP says: "Garages must not protrude past the front wall of the house and must be set back from the front boundary by 5.5 metres measured in a straight-line perpendicular from the centre of the garage door to the lot boundary." Given the setback you might be right, houses might be roughly in the same position, especially if people want to maximise their backyard space etc. From my understanding, the siting code states that the first house built/occupied dictates the set back. The council requirement is 5.5 mtrs (i think, i do remember a discrepancy between our sub division and covenant) but if you have some odd ball that wants to place his house 9mtrs from the road then you have to conform if you have no opposing neighbor. If you do then i think its based on an average of the surrounding setbacks. In regards to the fence, im assuming its first in best dressed. As most garages will be parallel to the neighbors living portion of the house, the min set back that i think most will comply, should over ride fence lengths if floor plans deviate from one another substantially. eg lot 01 - garage proud from living, lot 02 - garage set back from living. If that makes sense..... hard with our drawing it out! haha Yeah I don't know why I came to a forum.
