Well I decided after todays discoveries to start this forum so people may learn from others mistakes.
So please share with others what you have learnt from your mistakes or even from someone else.
This is the truth from my discoveries and understanding
It seems today is just another thing I have to learn as does my friend, in a perfect world people would be honourable and trustworthy and stand by what they said. My friend who works on the mines and has asked for me to help her with details, emails etc and do the contacting and chasing up queries for her with land, building and finance while she is at work. She works 4/1 and has 1/2 hour lunch breaks so obviously a very busy person who is unable to take calls and emails anytime of day.
She went to her meeting for purchasing land with LWP up at Trinity Estate at Alkimos WA, and the block she was interested in was trinagular in shape, large front moving to a smaller rear. She was very clear and asked if she could have the front part of the yard next to the house fenced in utilising that bit as her side/backyard. The sales man said yes, they would fence that part in and grass it, and the rest of the front yard directly at the front of the house would be landscaped. She was adament that this is what she wanted otherwise she would not buy the land as she had plans for a pool. I hope you get the idea of what she wanted to do.
So when she went back to get it on official documentation the salesman suddenly failed to remember the conversation, acted dumb and said he has never ever had a request like this before. He then passed it off to someone else, who seemed confused at the grass idea and gave us the standard spiel of how they landscape the blocks, He also said the salesman should have written everything that was arranged on the paperwork
I called after getting the standard email today and was welcomed by a very rude woman in the office, I wanted information on canceling the contract due to misinformation, and she accused me of being rude and argumentative when I corrected her when she started saying that the builder told her this would be done, not the land salesman. I mean how dumb do they think mt friend is, I am sure she knows the difference between the land salesman and Building salesman. I was then told they should not speak to me as they do not have permission from my friend, who specifically arranged this with each and every company that she needed to speak to. So once again this salesman at LWP didn't do his job. This made me certain my friend had not got anything confused or misrepresented and that the salesman failed miserably or deliberately at his job.
I was told that she cant get her deposit back unless she is declined by finance, which is totally unfair due to the fact they have breached the contract by not puting this information into the paperwork. Everyone is passing the buck, so I lodged a complaint for her with the company the first step before I take it to DOCEP for her.
Lesson learnt is to not leave an office after puting a deposit down without absolutely everything in writing, and I have advised her to voice or video record all meetings, this sounds far fetched to go and record it, but what else can you do when it seems the norm to tell you what you want to hear. I guess it is always good to go back and listen to it afterwards just incase you missed anything. I would also suggest walking away and let the emotions settle before finalising paperwork.
I will keep this updated to see if LWP take a professional approach and either offer what she wanted, or give her the deposit back, anything else would be dishonest.
