Im at the 11th hour of purchasing a block of land at Torquay. I have had a conveyor go thru the contract of sale and section 32 and all is well. The section 32 identifies a sewerage easement well away from the lot I'm purchasing which doesn't affect me at all. The agent who is acting on behalf of the developer previously gave me the Stage lots brochure, which on an earlier Stage has an sewerage easement cutting thru a proposed "future development" which is the stage I'm currently looking at. The easement runs directly in front of my land and stops (will it go straight, left, right, nobody knows. This is a sales brochure so its not final, but its there which is of concern.
I am looking to put a pool onto the property in the near future so any easement would destroy that idea? I specifically chose this block with the fact it has no easements on it.
The land is due to title Jan 2013 give or take 3-6 months as we all know!
My question is, are ALL the easements defined in the section 32 final, or is the developer/council able to introduce additional easements onto lots without informing potential owners/buyers? I wouldn't like to find out close to settlement that i can't build my dream house and start land hunting all over again!
