Browse Forums Buying Land 1 Jun 20, 2011 1:47 pm When we initially looked into buying our block, we were sent info which stated "..once you step up onto the land itself, the block has only a gentle slope of only 80cm approx over the entire block." We put down a $10k deposit and it is due to settle in just over a week. However, when the site tests were done (by the builder), we were advised that it was "double what we initially thought". When questioned, we were told a 3m slope. Do we have a case for false advertising as this obviously changes all our initial plans. Or will the buck be passed back to us that we should have had an independant survey done? We went ahead with the purchase as it is in the suburb that we wanted to build, and was advertised as "..actually one of the flattest blocks you will see in the estate." PLEASE HELP! 3Jun 20, 2011 1:58 pm The contours may have changed when they developed the land if the road wasn't in when you initially saw the block. This happened to some blocks near me, once the road went in the land changed considerably and the developer ended up cutting their sites for them as compensation after a bit of a battle. As stated above, it is important to know what is in your land contract. I leave you to fend for yourself, figure things out yourself. Terrence Malick Re: False Advertising????? There were only 2 blocks left in the court when we saw this one (ours & 1 other); all the rest of the houses were already under construction. The only thing not built is the footpath, so I presume the subdivision report measurements are exactly what we looked at "in the flesh"? Re: False Advertising????? In the land contract there should be a drawing of the block with lines across it (on ours each line represented 20cm from memory) showing how the land alters in height. If it was as it is now when you bought it, I'm not sure you have too much recourse though. I'm unsure on the legalities of it if the land was developed when it was bought. We got a copy of the survey report form the builder which shows the "contours", but only after the fact. This 1+ When we bought our block we received 'Contract Plans' with a provision about allowable differences in gradient etc, once the 'As Contructed' plans were provided. From memory the developer had a pretty big leeway in what they proposed, and what they actually had to deliver. We were fortunate that the 'As Constructed' plans did not differ significantly,we didn't encounter any issues. I guess that outlines the importance of having a solicitor review any contract that you sign to explain to you what potential problems you might encounter. That being said - I doubt the developer would have even sold you the land if you requested a clause that the land was subject to an independent survey. Cheers atom_ute Re: False Advertising?????
