My Mrs only condition in living in any house is to have a white pickett fence out the front. So not sure what I'll do. It basically outlines what you need/don't need a permit for when it comes to retaining walls, verandahs, pools etc, basically the things you will do after you have built. Which would suggest to me that if the fence is less than 1.5m and made of wood, that you can go put a fence anywhere you like out the front. This might be why you see the fence already constructed up the west end by stage 2 has an angled section down to the road? An example is 9.10(b) of the document states that Uncoated galvanised or zincalume steel sheeting must not be used on the Land under any circumstances. The council does not care about the fact you have used zinc sheeting etc to build something, however the MCP document will not allow such items to occur on the land. Even though council may or may not require that you get a permit for something, if it's stipulated in the MCP It overrides it. But I assume that the signed contract with the Memorandum of Common Provisions (MCP) would form part of the council requirements for the estate? I don't know what overrides what though... I'd just hate to pay for my share of a fence on both sides and then find out I need to rip 5-6m of it down to comply with council/MCP.
