Browse Forums Pools & Spas 1 Sep 01, 2014 4:48 pm New poster on this forum but have been looking at other people's posts for the past few months as we have just started renovating our 1940s Perth bungalow. This is a bit of a saga, so I will try bullet points to make it less long-winded! * In June we signed up for a Freedom pool, to be installed in August. * Our house has power lines out the front, so we were told the best way to crane lift the Fibreglass pool would be from a side street, 3 houses down from ours over three neighbours' backyards. * Freedom told us they would take care of contacting and advising the neighbours and providing them with insurance documentation. * We spoke to our next door neighbour 3 weeks before the crane lift and he advised he had heard nothing from Freedom, but would be ok with the lift if we got him the insurance docs * My husband contacted Freedom to see where they were at with advising the neighbours, and could he get a copy of the insurance policy, Freedom said they were on to it, and would email him through the info. * Two weeks later still no info, my husband calls, leaves message doesn't hear back. * Day before pool install, still no answer, woman emails my husband at 9.30 at night with the insurance doc, but he still has no idea if she has let the neighbours know * Day of install, my husband has to go to hospital with my son who needs stitches (whole other story!) and I am at work * Crane parks next to neighbours on the end's house, knocks on door, owners go ballistic and say no way * Crane and pool leave, we have a big hole in our backyard with no pool in it * After calling the Crane company they say we CAN lift without the neighbours permission because they don't own the air above their house, and they don't see any alternative lift that will satisfy worksafe * Freedom don't care, they are now telling us it was the crane companies job to notify the neighbours although they told us they would do it more than once * We think our only option is to put in a concrete pool, which freedom have quoted as costing $7000 more My questions are: 1. Do Freedom have to take some responsibility for this disaster? I feel like if they had of notified the neighbours when they said they would and provided the insurance docs this could have been averted. 2. Do the neighbours have a right to say no over someone lifting a crane over their house? I really don't want to do this if they are not comfortable with it. Re: Help - Pool Drama! 4Sep 01, 2014 8:17 pm Not sure i am understanding this correctly but if you have hired someone else to do the job isnt their responsibility to organize everything. ALso if you change pool type you may need it re engineered and therefore apply for permits again, which mean additional cost which they will just pass onto you. Re: Help - Pool Drama! 5Sep 02, 2014 6:49 am Bridge Saint Mike Do you have this in writing ? No, unfortunately. They told my husband on the phone when he asked about letting the neighbours know that they take care of all of that. Yes - we were told things over the phone - from a reputable company. But - when the time came - they would only honour what was on the contract. The woman said - "he shouldn't have said that" or "its not written down on the contract" ... to our requests. We complained bitterly to the main office and got satisfaction - to a degree - but you MUST get it in writing !!! Help - Pool Drama! 6Sep 15, 2014 8:14 am I'd take reputable company with a grain of salt when it comes to pools. We had a concrete pool built by one of the largest pool builders in Victoria at the time. First they dug the hole too deep and never told anyone before concreting meaning instead of a 1.3m shallow end it was 1.6m deep! Then after almost 7 years (and near end of warranty) you could start to see the steel reo coming through he bottom and rusting out, I called them and advised and they kept palming me off and saying someone would call me this went on for a few weeks then warranty expires and 3 days later someone called advising that it was no longer under warranty and they no longer had to fix it. Company then shut doors and rebranded. For Vic I think a pool is a waste of money and a spa is a better option lol. Re: Help - Pool Drama! 7Sep 15, 2014 9:04 am I think B STAR is on the money Freedom is your builder. Under normal circumstances builder is responsible for everything (I hope there are no special conditions in the contract where you have to lift the shell in) I think they are just bluffing you and this is a job for a BC complaint and perhaps builders registration board. I don't see why you should pay more for a concrete pool.
