The builder insists this should be done by the owner. I wanted to understand what the industry norm is here. For my own protection I would prefer to hold off making the last progress payment until I get an OC. Naturally builder is reluctant. Secondly anyone knows whats realistic penalty for late compleiton of the project. From memory I thought this was a line item that requires confirmation. I.e client or builder is responsible. Also a liquidated damages clause should be written into the contract, usually approx $500 per week for every week they go over the contracted completion date. The only way for a builder to avoid damages is by having approved extensions of time for any variations or wet weather delays (Which should be signed by you within 14 days of the delay taking place, not at the end of the project). Again really comes down to your contract, and it might be worth getting legal advice if needed. Good luck.
