does anyone know when building works that are part of a renovation go from being 'an existing dwelling' to a 'new construction'?
I have tried googling and left a few message for council but no luck to date.
This query relates to a renovation in a BAL 40 & FZ area, the house was stripped back to the frame work with no roof or internal or external walls. The existing footprint was extended on 3 sides (including 1 on the BAL FZ side) and some additional framework on another (also BAL FZ) plus a new 1st floor addition.
DA compliance indicates if new construction then AS3959 standards must be met but if existing dwelling just needs to be upgraded to reduce ember attacks.

We're a builder and I would imagine that if you have kept the frame and footings, then you are still doing a renovation (and addition) to the existing house, not a new construction.
Keeping the frame of the existing dwelling is the key, I believe. Definitely follow this up with your Council to confirm.
