We have a renovation planned which all falls within the complying development requirements. The one thing we are unsure of is that we would like to add a bay window to the side of our place, off the dining room. My understanding is that as soon as you change the footprint of your lot it becomes a DA, however this wouldn’t be a footprint, it would just be a window (a large window, but still just a window and it doesn’t go down to floor level of that room). Because of the slope of the lot, that window is about 2m above ground level, and the window wouldn’t extend into the boundary setback, there is enough space between to house and the boundary to still meet the 90cm setback needed once installed. Does anyone know if this falls into a window replacement, and therefore could be complying, or if its considered a footprint change, and therefore DA? I have done a reasonable amount of reading of the rules but couldn’t find anything addressing bay windows. Thanks in advance. Did you notice, you first said it wouldnt be a footprint change, then subsequently, you ask if it is a foot print change? So why the uncertainty? The location is on the lower northern beaches in Sydney (near manly) and the place is a single level semi detached house. The window is on the eastern side of the house, along the side wall, at the rear. I'll try to take a photo across the weekend. If a protruding window is considered a footprint then it would be a footprint change, but in the true sense of the word, its an elevated protrusion in a small section, and doesn't change the base of the building at all.
