First post We are selling our house. this was a new build from porter davis and has been a nightmare We are trying to sell but have been told the retaining wall installed at construction should have fall protection. The wall is on one side of the house about 3 meters from the fence and because the height. the drop to the lower ground level is 1.7 Meters (and its largest) it was illegal and a fall protection should have been installed Can anyone give me some advice? should there have been one installed at build? A lot of retaining walls and terraced gardens the authorities tend to turn a blind eye but 1.7m is pushing it a bit. Depending how long it is, it shouldn't cost much to put up something that complies to the regs and looks great. Thanks What sort of retainning wall is it ?....I would doubt that the Builders engineering drawings shows Balustrade/Fencing (although mine do) which is generally installed by the fencing contractor. IMO,the Building Contracts & Codes dont adequately deal with Non Compliance Unfortunately, In some cases the balustrade can cost as much as the Retaining Wall and now the Council/Building Surveyor may now insist that it is properly certified and installed/built. As far as I can recall a retaining wall DOES NOT require a balustrade unless it is associated with a path or travel between buildings. There is an exemption in the BCA for retaining walls.
