The land title says that it is a cross-easement under Section 181B of the Conveyancing Act 1919. Have looked online and don't quite understand what it all means. Our architect has advised us to build on our half of the party wall only, but a builder has advised it is easier to simply extend the entire part wall (cavity brick). Does anyone know what our legal obligations are? To complicate matters, there is a brick chimney straddling this wall which we would need to extend and which the neighbours have consented to. The double brick cavity wall needs to be there for fire separation despite the fact when you extend up there is no adjoining dwelling on that level. If you build as the architect is saying you cannot just have a single leaf brick wall as your external wall. You would have to build a timber stud wall plus cavity on your side as well meaning you would also lose another 150mm essentially turning that wall into a brick veneer wall. For strength alone extending both sides of the cavity at the same time is the way to go. You just have to get a letter of consent from your neighbour ( with the right legal documents as well ) and be prepared for the cost of the extra brickwork. Anyone like your neighbour if they have any brains, would jump at the chance to have their part of the wall built for nothing. It is a win/win for both of you in a way. Stewie This was on google.
