Our neighbour as wants to extend their house. They've sought compliance advice from the BCC, and the BCC has said their plans are compliant. I'm sure the next step is they'll apply for a Siting Variation, which will be approved. We strongly believe that the extension ISN'T compliant, and we'd like to "take things further". However, my initial research on appeals to the Planning and Environment Court makes me think that only the APPLICANT, ie my neighbour, can appeal. Not us! We're just the poor suckers who live next door. I do intend to engage a solicitor, but for now I'm doing my own research. So, if you don't mind, a few questions; 1. Can a neighbour "appeal" against an approved Siting Variation? If so, how? 2. They have a low-set, brick house. The extension will be part-of/attached to this, and its function will be a garage. Is this extension a Class 10a building? Or is it the same class as the house (ie class 1)? 3. The Queensland Development Code MP 1.2 has a series of Performance Criteria and Acceptable Solutions. Can the Acceptable Solutions be FULLY relaxed themselves? Or must the extension meet one or more Acceptable Solutions? One of the reasons I don't think it complies is it fails to meet at least THREE of the Acceptable Solution sections. 4. Their plan shows a Road Clearance of "3.3m to OMP". I can't tell if this is from the OMP (of the building) to the gutter/road, or some other point. I looks to me as if their extension will be MORE than 3.3m from the gutter, so I'm not sure what they mean by "3.3m to OMP".
